MODIFICATION OF RULE 41
It is agreed that the provisions of
Rule 41 of the current agreement between the Order of Railway Conductors,
Brotherhood of Railroad Trainmen, and Union Pacific Railroad Company,
effective June l, 1941, are hereby modified with respect to its application on
the Fifth District, Cheyenne-Laramie, to the extent herein provided:
1. Pool freight crews that have been
runaround in the Cheyenne Yard or between Cheyenne and Laramie will, upon
arrival at Laramie, be given the same relative position on the list at Laramie
that they held prior to leaving Cheyenne as far as consistent, except as
provided by Section 5 hereof, and will be called in that
Crews with less time to work than
required bv rules 42(a) and (b) of the current schedule resulting in their
being run around at Laramie, or who do not arrive Laramie in time to take their
turn out, will, upon arrival at Cheyenne, be given their same relative position
on the list at Cheyenne as they held prior to leaving Cheyenne on the last trip,
as far as consistent.
2. Pool freight crews who are runaround
by other pool freight crews in the Laramie Yard or enroute between Laramie and
Cheyenne will, upon arrival at Cheyenne, be given the same relative position on
the list at Cheyenne as far as consistent that they held prior to leaving
Laramie on the last trip, except as provided by Section 5 hereof.
3. Upon arrival at Cheyenne or Laramie,
trainmen who have been runaround, as indicated in Sections l and 2, will notify
proper officer as to their standing on the list at Laramie or Cheyenne. The
company will not be subjected to penalty payments because trainmen fail to
furnish information, or furnish incorrect information. This does not, however,
estop the management from taking disciplinary action when it is developed the
employee have deliberately furnished incorrect information.
4. No runarounds will be claimed
because crews did not depart in their first in, first out order at Cheyenne or
Laramie. '
5. Pool freight crews making short turnaround
trip out of either terminal will take position on list as per arrival at
terminal, except crews who make less than 150 miles, or the equivalent thereof,
on a turnaround trip out of home terminal will stand first out 12 hours after
tying up, unless they become first out prior to that time.
6. This agreement is effective April
18, 1955, superseding the agreement dated November 27, 1953, and will
automatically terminate ten (10) days after service of notice by either party upon
the other of desire to terminate it, at which time the schedule rules affected
by this agreement will be in full force and effect.
