September 27, 1963

 

Superintendent Shanahan advises that Local Chairman Ponte has requested an agreement be negotiated in regard to calling of extra brakemen for freight and/or passenger service west out of North Platte.

 

We are agreeable to modifying Sections (b)(3) and (4) of Rule 43, "Calling‑Extra Brakeman" of the agreement between the Union Pacific Railroad' Eastern District, and Order of Railway Conductors & Brakemen and Brotherhood of Railroad Trainmen, effective November 1, 1957, to read as follows:

 

"EXTRA BRAKEMAN LAYING OFF OR MISSING A CALL AT HOME TERMINAL. An extra brakeman who lays off or misses a call will not be permit­ted to report for service until after the brakeman who accented the call returns to the home terminal, at which time the brakeman who laid off or missed the call will be placed on the extra board following the brakeman who accepted the call, and following any other extra brakeman who tied up at the same time. In no event will the extra brakeman who lays off or misses a call be permitted to report for service until after the expiration of sixteen hours from the time he misses a call or is authorized to lay off."

 

"An extra brakeman who lays off or misses a call for an outlying vacancy will, upon re­porting for service, be required to relieve the brakeman who accepted the call if he is still occupying the outlying vacancy."

 

"The Company is not estopped from admin­istering such discipline as it deems proper to a brakeman for missing a call. This rule will not operate to the detriment of the service and the company will not be penalized in any way in the application thereof."

 

The provisions of this rule will apply only when there are other extra brakemen available.

 

     This agreement is effective October 15, 1963 and will automatically terminate 30 days after service of written notice by either party upon the other of desire to terminate it, at which time the schedule rules affected by this agreement will be in full force and effect.
