AGREEMENT
between the

UNION PACIFIC RAILROAD COMPANY-EASTERN DISTRICT
and the

ORDER OF RAILWAY CONDUCTORS AND BRAKEMEN

VACATION SCHEDULES – CONDUCTORS AND BRAKEMEN

Section 6 of the "ational Vacation Agreement effective
July 1, 1949, reads in part as follows:

'•Vacations shall be taken between January let
and Decenber 31st; however, it is recocniced that the
exigencies of the service create practical difficulties
in providing: vacations in all instances.  £ue regard,
consistent with requirements of the service, snail "^e
given to the preference of the en;ploye in his seniority
order in the class of service in which engare. when
^rar.ting vacations. Representatives of the carrierr and
of the employes will cooperate in arranging vacation
periods, administering vacations and releasing employes
when requirements of the service will perr.it. "

In applying the above-quoted provision e." a-reemer.t in a
manner which will perr/dt of orderly procedures in sc.-.eculinr ar.d
grantir." vacations, it is agreed:

1.  Superintendents will deter:.;i"e as soon as consistent
the employes who are qualified for vacations of ?,
14, 21 or 2S days in accordance with the i-r^e.v.ents
effective January 1, 19^5.

2.  The classification of employes, that is, ---nether

they are conductors or c-ralce^en, for the purpose of
selecting vacation periods o." 7, ii., 21 or 23 ca-/s,
will be determined by the grade of service to vhich they
are regularly assigned on I.ovenber 15 pricr to their
vacation year,

3.  List of conductors eligible for vacation will be pre-
pared in seniority orcer for each seniority district,
and ccpy furnished the local chairman of ihe C.?..C.i3.
Sinilar list of bra*:enen eligible for vacation v.ill be

Local officers and local chairmen will der.er-ine to
the best of their ability the nur.ber of concuctDrs
an- brakemen on each seniority district '..'ho car. i»
granted vacations throughout the year consistent
with requirements of the service.

Conductors and brakencn \.-lll be ^iven opportunity to
select vacation periods in seniority oruer in each
seniority district.

Vacations as selected in accordance with the above
will be shov/n on the vacation schedule separately for
conductors and brakemen for each seniority roster,
and copy furnished the respective local cf.airr.en.
Dates selected will not be" subject to char.re thereafter
except that if it is founu there is a surplus of r.en in
any seniority district, employes desiring" vacation at
that tine nay be relieved on request of t;:e individual
and approval cf the officer in charge, givin- preference
to senior r.en, and assi-ned vacation period cancelled.

If conditions will not permit the granting of vacation
as scheduled, payment will be nade in lieu thereof in
conformity with the vacation agreement.

In cases where enploye fails to select vacation period
he trill be assigned vacation period by local chairr-an
and representative of the cana^er.ent.

This Section \n.ll be applied as follows:

August 1st. On July 31st he is called at the far
ter^-al at 10:00 p.-., and arrives at the hone terrtinal
at 3^;^0 a.e., on nugxist 1st. The employe will be con-
sidered as having begun his vacation at 12:01 a,s.,
August 1st.

Exanple 2

*n etiploye is scheduled to be^in his vacation on
August 1st.    On .tu^ust 1st he  is called at the far
terrdnal at  12:10 a.m.,   and arrives at the hone
terminal at 5-10 a.h.,  on August 1st.    The employe will
be considered on vacation at 12:01 a.ja.,  August 2nd.

* yard employe is scheduled to begin his vacation
on August 1st. On July 31st he goes on duty at 11:59
jp.m. , and goes off duty at 7^59 a.m., on August 1st.
The enploye will be considered as having be^un his
vacation at 12:01 a.r.. , August 1st.

A yard employe is scheduled to becin his vacation
on August 1st. On July 31st he goes~on duty at 3-59
p.m., and works a yard shift plus one hour overtime,
going off duty at 12:59 a.m., on August 1st.  The
cuploye will be considered as having begun his vacation
at 12:01 a. a., August 1st.

10.  This agreement is subordinate to any interpretations
of the National Vacation ngree-ent by the co^ruttee
provided for in Section 1C of the national Agreement
dated April 29, 1949 and effective July 1, 1949, and
shall terminate thirty days after written notice
served by either party upon the other.

11.  The agreements dated April 7, 1953 and February 10,
1954 with the GRC&B and BofRT; the agreement dated
January 6, 1954 with the BofRT; and the asreecent
dated June 22, 1963 with the Four Operating Organisations
are hereby superseded and cancelled.

This agreement is effective January 1, 1965.
