MODIFICATION OF RULE 13(a)

FIFTH SENIORITY DISTRICT - CHEYENNE

Rule 13(a) is changed as follows for application to engineers on the Fifth Seniority District at Cheyenne:

(a) 1. When a passenger engineer lays off or goes on vacation, the senior freight engineer making application for such vacancy will be assigned to the run. On the five (5) day layover period of the assignment, such engineer has the option of remaining on the passenger assignment or returning to his regular freight assignment. The engine crew dispatcher must be notified by such engineer of his desire to return to freight service. Such engineer must submit a new application to return to a passenger vacancy.

2. If no written applications are made for temporary vacancy, the senior regularly assigned passenger engineer on his five-day layover will be given the opportunity to fill the vacancy on a trip-by-trip basis, if such use does not preclude him from being available for his own assignment.

3. If the use of (a)1 and (a)2 fails to fill the vacancy, it shall be filled in the following order:

(1) use the senior freight engineer with application on file for passenger work.

(2) use the last in, rested, qualified, pool freight engineer who will be required to take the vacancy on a trip-by-trip basis.

(3) call the engineer who is first out and qualified on the extra board.

4. Extra or unassigned passenger trains will be filled by the first out pool freight crew.

This agreement is effective March 1, 1982 and may be terminated by service of a 10-day written notice by either party upon the other.
