Dear Gentlemen:
In regard to your Organization's concern with respect
to the intent of the specific moratorium provisions set forth in
Article XII, Sections 2 and A, which both read, in pertinent
part, that "nothing in this Modified Crew Consist Agreement
restricts the Carrier's right to pursue 'Conductor-Only1
operations under the provisions of any subsequent UTU 'National
Settlement'", this letter confirms the Carrier's intent.
The only reason for the Carrier's insistence that these
sentences be placed in the Agreement, both in Section 2 and
Section 4, is that it would be indisputably clear that this
Carrier would have the right to pursue Conductor-Only operations
if such right were to be permitted by a National Agreement.
I trust this letter explains the reasons for Carrier's
language in the general section of the Modified Crew Consist
Agreement.
