ARTICLE 75 APPEALS 1 I - TO THE BOARD OF APPEALS 2 (a) An officer or member of a local may appeal from an action or 3 decision of a local to the Board of Appeals, except as provided in 4 Paragraph (c) below. Such appeal shall be filed with the General 5 Secretary and Treasurer within ninety (90) days from the date the 6 action or decision occurred. 7 (b) A subordinate body may appeal an action or decision against it 8 to the Board of Appeals, provided such appeal is filed with the General 9 Secretary and Treasurer within ninety (90) days from the date the 10 action or decision occurred. 11 (c) An officer or member of a local may appeal from an action or 12 decision of a Local Committee of Adjustment to the appropriate General 13 Chairperson, provided such appeal is filed with the General Chairperson 14 within ninety (90) days from the date the action or decision occurred. 15 (d) A local or member of a local may appeal from an action or 16 decision of a General Chairperson to the General Committee of 17 Adjustment, provided the appeal is filed within ninety (90) days from 18 the date the action or decision occurred. Appeals to the General 19 Committee of Adjustment must be filed with the Secretary of the 20 General Committee and shall be acted upon not later than the next 21 session of the General Committee of Adjustment. --50-- 22 (e) An appeal pending before a General Committee of Adjustment 23 which has not been acted upon within ninety (90) days shall be referred 24 by the Secretary of the General Committee of Adjustment to the Board 25 of Appeals for a decision, provided the appellant makes a request to do 26 so to the Secretary of the General Committee at least thirty (30) days 27 prior to the date the Board of Appeals is scheduled to convene. 28 (f) An appeal from the decision of the General Committee of 29 Adjustment may be made to the Board of Appeals provided the appeal 30 is filed with the General Secretary and Treasurer within ninety (90) 31 days from the date of the decision of the General Committee of 32 Adjustment. 32 II - TO THE BOARD OF DIRECTORS 33 (a) A member or subordinate body may appeal to the Board of 34 Directors from an interpretation of this Constitution made by the 35 International President, provided such appeal is filed with the General 36 Secretary and Treasurer within ninety (90) days from the date the 37 decision by the International President was made. 38 (b) Actions or decisions of Trial Boards may be appealed to the 39 International President, provided such appeal is filed with the General 40 Secretary and Treasurer within ninety (90) days from the date on which 41 the action or decision occurred. The General Secretary and Treasurer 42 shall docket the appeal and present all papers relating to the appeal to 43 the International President. 44 The International President will promptly render a decision on the 45 appeal which shall be final and binding on all parties unless appealed to 46 and reversed or modified by the Board of Directors. Appeals to the 47 Board of Directors must be filed with the General Secretary and 48 Treasurer within ninety (90) days from the date of the decision by the 49 International President. 50 (c) Decisions rendered by the Board of Directors on appeals 51 referable to the Board shall be final and binding. 52 III-PROCEDURES 53 In all appeals as provided herein the party whose action or decision 54 is being appealed shall be allowed sixty (60) days from the date the 55 appeal is filed to reply to the appeal. 56 All appeals must be in writing, contain the pertinent facts involved, 57 and set forth the basis of the appeal. The parties involved in an appeal 58 shall exchange copies of the appeal and the reply thereto, and all 59 related correspondence. Copies of decisions involving appeals will be 60 furnished all interested parties. |
