RULE 123. HEARINGS—PAYMENT FOR ATTENDING. Engineers required to attend a. formal hearing held in accordance with Rule 122 as a witness only and not charged with a rule violation, or if charged with a rule violation and found to have been without fault in the occurrence under investigation and not therefore subject to discipline, will be paid for the time required to be present at the hearing, and for expenses, on the following basis:

1. Hearings—Off Duty Periods. When the hearing is held at the home or the away-from-home terminal points of the employe while he is off duty at those points and the hearing consumes four (4) hours or less from the time the hearing is scheduled to commence, the employe, if present at the scheduled time, will be paid one-half of a minimum basic day; when the hearing consumes more than four (4) hours the employe will be paid a minimum basic day. If the hearing is held at a point to which the employe is required to travel, he will be paid a minimum basic day, which payment will cover time consumed in traveling and attending hearing.

2. Hearings—Continuous With Service Payment. When the hearing is held immediately prior to or after completion of service, the employe will be paid while attending hearing actual time continuously with the service performance with a minimum of one hour.

3. Hearings—Time Lost Payments. If, by reason of attending a hearing, an employe is deprived of his regular assignment or turn on pool freight or extra board, he will be paid as follows:

(a) An employe holding a bulletined assignment will be paid an allowance equivalent to the earnings of the employe who fills his assignment.

(b) An employe in pool freight service who is held off his turn will be paid an allowance equivalent to the earnings of the employe who took his turn, and will resume his regular turn.

(c) An employe on the extra board will be paid a minimum basic day and hold his turn.

4. Time Payments. Time allowances payable to engineers under this rule will be at the rate prescribed for locomotives weighing from 250,000 to 300,000-pounds on drivers for the class of service in which engaged immediately prior to the hearing.

5. Expense Payments. Employes required to travel to point where hearing is held will be reimbursed for expense of meals and lodging at point of hearing.

6. The allowances provided for herein will not apply to employes attending informal hearings.
